Driving Convictions And Insurance

The Three Kinds of Driving Convictions

It is not only demerit points that affect your insurance premiums. There are common convictions that most people know about (like driving without your licence or mandatory car insurance coverage) that have costly consequences. But not all convictions are treated the same. The following are the three different kinds of driving convictions considered by insurance companies:

Level 1

Minor Convictions

It’s important to know that in Alberta, “I was only barely past the limit!” is never considered a valid excuse for speeding and you can technically be ticketed for going just 1 km/h past the posted speed limit. Minor driving convictions can result in potential fines and/or demerits based on situations that include (but are not limited to):

  • Speeding between 1 to 49 km/h over the limit
  • Failing to signal a turn or lane change
  • Ignoring a stop sign
  • Tailgating
  • Failing to yield the right of way to a pedestrian

How This Can Affect Your Rates

For these types of convictions, you could face a 25% rate increase if you have two convictions, with further increases for each additional conviction.

Major Convictions

Major driving convictions can result in heftier fines, more demerit points, licence suspension and/or mandatory court appearances. Major driving convictions include (but are not limited to):

  • Speeding 50 km/h or higher over the speed limit
  • Distracted driving
  • Failure to remain at the scene of an accident
  • Speeding in a school zone

A major driving conviction can result in a 25% rate increase. A second violation can result in a 50% rate increase.

Level 3

Criminal Code Convictions

Criminal Code driving convictions are reserved for the most serious offences you can commit while driving. Beyond fines, demerits, and insurance rate increases, they can result in the loss of your licence and jail time.

The following are examples of Criminal Code driving convictions:

  • Impaired driving
  • Dangerous driving
  • Failing to stop after the scene of an accident

For Criminal Code driving convictions, rates can increase to 300% for just one conviction.
